Terms and Conditions
- Scope of General Terms and Conditions: The use of the website as well as all deliveries and services provided by Christina Pott are exclusively based on the following General Terms and Conditions (AGBs). Deviating regulations, in particular the general terms and conditions of the contractual partner, do not apply, even if Christina Pott does not expressly object to them.
Deviant individual agreements between Christina Pott and its contractual partners require written form.
- Conclusion of Contract and Withdrawal: Christina Pott undertakes to accept the order of the contractual partner under the conditions of this website, including the General Terms and Conditions. In the event of typographical, printing, or calculation errors on the website, Christina Pott is entitled to withdraw without giving rise to claims by the contractual partner.
Oral information and promises, brochures and advertising statements of any kind, in particular descriptions, illustrations, drawings, samples, quality, nature, composition, performance, consumption, and usability specifications as well as dimensions and weights of the contractual goods are non-binding unless expressly designated as binding. They do not constitute any assurance or guarantee of any kind whatsoever. Minor deviations from the product specifications are deemed approved unless they are unreasonable for the contractual partner.
- Delivery: Unless otherwise agreed, delivery is made to the delivery address specified by the contractual partner. Statements regarding delivery times are non-binding. An agreed delivery period is deemed to have been met if the goods have been handed over for transport by the deadline or if readiness for dispatch has been notified by the deadline.
In the event of delivery delays due to force majeure, natural disasters, strikes at own operations, suppliers or carriers, or due to other circumstances beyond Christina Pott’s control, Christina Pott is entitled to make the delivery after the obstacle has been removed. However, both parties may withdraw in whole or in part from a concluded contract if any of the aforementioned events lead to a delivery delay of more than three months beyond the agreed deadline. Further claims by contractual partners are excluded. Christina Pott is entitled to partial deliveries of quantities of goods.
- Due Date of Purchase Price and Payment Methods: The purchase price is due upon order confirmation. Payment can be made by advance bank transfer, PayPal, or credit card. The specified delivery periods begin upon receipt of funds in Christina Pott’s account in the case of a bank transfer. Christina Pott reserves the right to exclude payment methods.
ADVANCE PAYMENT
Total purchase price is transferred before delivery. After receipt of payment, the goods will be shipped.
PAYPAL
Total purchase price is paid via Paypal before delivery. After confirmation of payment receipt by Paypal, the goods will be shipped.
CREDIT CARD
Total purchase price is paid by credit card before delivery. After confirmation of payment receipt by Stripe, the goods will be shipped.
- Shipping Costs
The shipping costs are:
Within Germany: 9.00 Euro Europe and Switzerland: 20.00 Euro Worldwide: 30.00 Euro
Shipping within Germany is done by DHL in an insured and traceable package. Outside Germany and for goods worth more than 500.00 Euro, insured and traceable shipping is done by Bertram Juwelier Service, which cooperates with UPS. Prices vary depending on the type and amount of insurance.
- Delivery Times
Delivery time: 7 – 12 working days, after receipt of payment.
- Retention of Title: Until full settlement of all claims against the contractual partner, the delivered goods remain the property of Christina Pott.
If the contractual partner is in default with one or more payments in whole or in part, stops his payments or an application for the opening of insolvency or judicial comparison proceedings is made about his assets, then the contractual partner is not allowed to dispose of the reserved goods. Christina Pott is entitled in such a case to withdraw from the contract or to take back the reserved goods for the purpose of other use or to revoke the contractual partner’s authorization to collect the claims from the resale. Christina Pott can then request information about the recipients of the reserved goods, notify them of the assignment of the claims and collect the claims itself.
- Warranty and Liability: In case of defects in the ordered goods or in case of the absence of assured properties, Christina Pott, at the choice of the buyer, is initially entitled to rectify the defective item or to deliver a replacement. After the second failure or impossibility of rectifying the defective item or delivering a replacement within a reasonable time, the contractual partner is entitled to reduce the purchase price (reduction) or cancel the contract (rescission). Obvious defects must be reported by the contractual partner immediately, but no later than two weeks after receipt of the delivery from Christina Pott, in writing. Other defects that cannot be discovered even with careful examination within this period must be reported to Christina Pott immediately after knowledge in writing. Excluded from the warranty are damages caused by natural wear and tear, improper use, and inadequate or incorrect maintenance.
Unless otherwise stipulated below, further claims of the purchaser – for whatever legal reason – are excluded. Christina Pott is therefore not liable for damages that did not occur to the delivery item itself. In particular, Christina Pott is not liable for lost profit or other financial losses of the contractual partner.
The warranty period is 2 years and begins with the transfer of ownership of the goods.
- Data Protection and Data Backup: To the extent that the contractual partner transmits data to Christina Pott, regardless of the form and format, he shall make backup copies thereof. In the event of data loss, Christina Pott is only liable for damages under the above liability limitations that could not be prevented by backup copies made by the contractual partner. If data losses occur during the use of Christina Pott’s website by the contractual partner, Christina Pott shall not be liable under any circumstances.
Christina Pott is entitled to store all personal data required in connection with the use of the website and to transmit it to third parties to the extent necessary for the initiation, execution, and settlement of a user relationship. Further use of personal data depends on the user’s consent.
- Return Policy
Right of Return: The received goods can be returned within 2 weeks without stating reasons by returning them. The period begins at the earliest with receipt of the goods and this instruction. Only in the case of goods that cannot be shipped as a parcel (e.g., bulky goods), the return can also be declared by a written request for return, i.e., by letter or email. To meet the deadline, it is sufficient to send the goods or the request for return on time.

Consequences of Return: In the event of an effective exercise of the right of return, the mutually received services must be returned and any benefits derived (e.g., benefits of use) must be surrendered. Compensation may be demanded for any deterioration of the goods. This does not apply if the deterioration of the goods is exclusively due to their examination – as it would have been possible, for example, in an atelier. In all other respects, you can avoid the obligation to pay compensation by not using the goods like an owner and by refraining from doing anything that impairs their value.
- Final Provisions: German law applies. For contracts with merchants, the place of performance is Paderborn. Paderborn is the exclusive place of jurisdiction.
- Severability Clause: Should individual provisions of these Terms and Conditions or the contract concluded with the contractual partner be wholly or partially ineffective, this shall not affect the validity of the remaining provisions of the contract.
